Nick is a paralegal working for a law firm. He is asked by the attorney to have a client on an existing case come in and sign a contract for representation. The file does not contain a contract from the initial meeting with the client, and the attorney claims that this was somehow missed at the initial meeting. Among other things, the contract waives responsibility on the part of the lawyer for any loss of evidence left in her possession. Nick knows for a fact that the lawyer recently left her briefcase in a bar and lost several client files including that of this client. Nick also remembers the lawyer telling him that she was concerned because several Polaroid photos to be used as evidence in the case had been in the file and could not be reproduced. Should Nick ask the client to sign the contract without divulging this information?
