Glen Corporation owned the mining rights under land owned by James. As a result of prior contractual agreements, it was not liable for sinking of the surface due to its mining activities, nor for damage which might thereby be done to surface properties. Before starting active mining below James’ buildings, Glen Corporation promised in writing to prop up James’ buildings to prevent their collapse, and to restore them to their original condition if they were damaged, if James would permit their workers to come on his land to do this work. James agreed. Subsequently the Glen corporation refused to continue with its repairs to the property which had sunk dangerously as a result of its mining operations. James sued the corporation for the reasonable cost of the repairs. Defense: No consideration. Discuss fully the principles involved.
